What are some of the things you need to know about a Special Warranty Deed?

calligraphy pen writing on paperA special warranty deed guarantees that the grantor owns and can sell the property. To the best of their knowledge, they are the owner of the property. A special warranty deed does not protect you against any mistakes that could have occurred prior to the owner purchasing the property. With a special warranty deed, there could still be liens and judgements clouding the title of the home. In order to sell with a general warranty deed, a special warranty deed is required. Traditional financing usually requires a general warranty deed. A special warranty deed does not include title insurance. We do not provide title insurance at our office. It is the responsibility of the new property owner to obtain title insurance and homeowner’s insurance, because neither are guaranteed with a special warranty deed.

FAQ

There are different types of transactions that you can use for selling a home. Some sales contracts have restrictions such as inspections and surveys that are required. With a special warranty deed, you do not have some of the complications that you could have with different sales contracts. With a special warranty deed, you can sell your home as is.

When you gift a property the person that receives the gift can be subject two different types of gift taxations or income taxation. Using a special warranty deed, you can give a property to someone, for consideration of $10, & it is treated differently under taxation rules.

When you gift your property under a gift deed, the tax basis of the property for the giver can become the tax basis for the recipient. In that case if the person receiving the property sells the home right away, they may be facing steep taxes.

Gift deeds are complicated and tedious to uphold. Compared to special warranty deeds, Gift deeds have nuances that sometimes do not hold up in court. It is more likely for a gift deed to be challenged, than a special warranty deed.

The Donor can, at any time, revoke the gift deed document & is not legally obligated to give the gift. This is important to have two disinterested parties when signing so that someone who does not receive a gift and will not have a stake in the transfer of property. The Gift Deed can subject to challenge in court

We need signatures from all parties of the transaction, it then gets notarized, and recorded in County court records. If one of the parties is deceased, there are different legal options that you have, for that person not being available to sign their signature.
