Corrected Deed Services for Property Records

A correction deed is a deed that serves to correct or negate a mistake made between parties whom have contracted an original deed agreement. The mistake can encompass minor things such as the misspelling of a name or major terms such as the price of the land. If both parties decide a correction is needed, then a simple correction deed should be constructed. It’s typically one correction and not 4-5 changes needed. The rest of the deed is valid. Generally, all parties who signed the prior deed must sign the correction deed in the presence of a notary, who will acknowledge its execution. Then record it in the country court records system to make it valid. We do that here in our office. Correction deeds may have minor mistakes such as misspelled or incomplete names, missing middle initials, or excluding the marital status. They may leave out other investing information or property description. There are sometimes errors in recording the plat, deed reference lot number designation, or legal description. The corrected deed amends the defects of the original deed. Price: $300 (Setup an Appointment).

What is Not Covered on a Correction Deed

Please note that correction deeds are not sufficient to add or change an element to the existing agreement with both parties. In such a case, a new contract should be drawn up. Correction deeds simply change one specific element of a contract, and leave the other pieces of the puzzle intact. We will do a corrective deed for errors such as misspelling of names. We do not change verbiage and language in a corrective deed. If the agreement on contract changes with the new verbiage, there should be a new contract. A corrective deed means that the contract remains the same, but a clerical error or mistake is fixed.

When Do You Need a Corrected Deed?

When reviewing a deed or ownership of the title of a property, you must have the correct names that are on their driver’s license. This avoids errors and mistakes. We don’t recommend using the corrective deed for changing price or other major changes. It’s the person’s responsibility to update his/her last name due to marriage, divorce, or choice. A corrected deed is used to change a name if that person’s name has changed.
