Temporary Restraining Orders for Foreclosure Defense

A temporary restraining order (TRO) stops the foreclosure of a home, temporarily. This can last 30, 60, or 90 days depending on the situation. A TRO should only be used in certain circumstances like if the mortgage will be brought current or reinstated with payment within 30, 60 or 90 days. A TRO is used if there is a contract to sell the home, and the seller and buyer need a temporary amount of time to finalize the contract and complete the deal. We cannot guarantee the outcome due to numerous complicated factors. We can only make recommendations and suggestions, but the outcome is determined by a judge. We know that facing foreclosure is difficult. It is hard to know what legal actions you can take to help yourself and save your home. Who Needs a TRO - Temporary Restraining Order

A temporary restraining order is normally used when there’s a purchase sale contract on a home that has not been completed and needs time to be finalized. Sometimes the date of the foreclosure does not allow enough time to inspect and negotiate all the details of the home purchase. The seller just needs a little more time to finalize and sell the property to avoid the foreclosure.

A TRO is not a fix to help avoid paying a mortgage payment for a small amount of time. This should not be used if you need time to move from your home or do not have a place to go if a home forecloses. TROs can be denied if the reasons are not valid or for any reason the court sees fit. We will not refund the cost of filing a TRO if it is denied.
