A temporary restraining order is normally used when there’s a purchase sale contract on a home that has not been completed and needs time to be finalized. Sometimes the date of the foreclosure does not allow enough time to inspect and negotiate all the details of the home purchase. The seller just needs a little more time to finalize and sell the property to avoid the foreclosure.
A TRO is not a fix to help avoid paying a mortgage payment for a small amount of time. This should not be used if you need time to move from your home or do not have a place to go if a home forecloses. TROs can be denied if the reasons are not valid or for any reason the court sees fit. We will not refund the cost of filing a TRO if it is denied.
A temporary restraining order stops the foreclosure on a home, temporarily. This can last 30-60 days depending on the situation. A TRO should only be used in certain circumstances where the mortgage will be brought to current/reinstated with payment in those 30-60 days or, if there is a contract to sell the home, where the seller and buyer need a temporary amount of time to finalize the contract, & the home will be sold in those 30-60, days.
You must bring $1,500 cash to our law firm no later than 48 hours in advance from the foreclosure if not sooner. We must have a reason for the application. An application for a TRO does not guarantee it will be approved. The $1,500 is non-refundable & is the cost for us to appear in front of a judge. There are also other court costs which can vary, please call for more information.
Yes. There are many circumstances where a TRO can be denied. Please explain the circumstance to our staff to see if there is legitimate reason for a TRO and we can assess if this is a good plan of action & likely to be approved. People take advantage of TRO’s and if multiple TRO’s are filed, there is likeliness they will not be approved.
