Release of Lien Legal Services

There are a number of reasons a release for a lien is necessary. One of the main reasons for a release of lien is that a loan has been satisfied either by an owner finance or another lien. Once the loan is paid off, make sure the title of the property is not clouded by that lien. We prepare the release of lien to make sure that all of the necessary documentation is completed, so you can rest assured the lien is no longer applicable. The other type of release you might need, is for a lien against your property for some other debt or payment. It is important to know that you have rights against the liens that are put against your property. The easiest thing to do is to pay it. That is the fastest and easiest way to get a lien removed. Once you pay it, we can help you with all the legal documentation to get the lien removed in county records and receive clear title. This process can take a number of days. It can take an undetermined amount of time for the lien holder to verify that it has been paid.

Learning More About Liens & How They Effect You

In some cases, the judgement can be removed due to being in an exempt bracket. This has to do with the category or type of lien and amount.

When there has been a lien wrongfully attached to a property, we have to find out if the legal procedure for filing the lien were followed. We see if we can get the lien removed for invalidity or defectiveness. Many property owners disagree with contractors and receive a mechanic’s lien, so we look into this.

A mechanic’s lien can be filed by any person who provides; labor, materials, machinery, fixtures, tools for construction, repair, or improvement to a house, building, levee, or embankment.

Examples of “improvements” to property for a mechanic’s lien:

  • Build a deck for a home.
  • Build a fence for an apartment complex.
  • Paint a building.
  • Replace the roof for a building.
  • Provide lumber for an addition to a home.

Selling a Home With a Lien

It is not impossible to sell a home if it has liens or judgements against it.

It is impossible to receive a clear title from a title company. This excludes traditional lenders from letting people obtain a loan for the home.

When you purchase a home, it is important that you either get title insurance or a clear title from a title company. If a home you’ve purchased does not have a clear title and you would like to remove the liens on it, then we can help you with that.

If you have been gifted a home or inherited a property with title issues, contact us to see what we can do to remove these liens. We can check the validity and see if there is a way to remove the liens without payment. In some cases, the judgement can be removed due to being in an exempt bracket. This has to do with category or type of lien and amount.
