Legal Solutions for Non-Performing Property Foreclosure

When somebody purchases a home from you, it’s under contract. If they don’t pay the agreed upon amount, delay payments, or don’t pay on time, then it is important to know what actions you can take to foreclose and take back the property. You need to know what is required to foreclose. You need to allow your buyer a certain amount of time to catch up the loan. The court process can be tedious. If the process is not followed correctly, an invalid agreement wastes time and money. Price: $1,200 (Setup an appointment here).

Other Things to Consider When Buyers Are Not Paying Thier Mortgage?

There are other things that can slow down the court process such as bankruptcy or refinance. Once you foreclose, the person you foreclosed on does not necessarily have to leave the home. You usually have to go through a full eviction process which is separate and can add more time to your timeline.

Our office files foreclosures for a flat fee. We take care of all the legwork required. There is always the option to work with your seller and avoid the headache and legal paperwork. If you can’t work out a payment arrangement or they default in their payments, then you need to know how to navigate through the legal process. The more time you are unable to sell, rent, or use the home, the more costs like taxes and loss of income can build up.

Do Not Deny Access to the Home

Remember you cannot lock someone out or keep someone from accessing the home even if they are behind in payments. Especially during COVID-19, you cannot just change the locks.

The Supreme Court of Texas issued an emergency order to temporarily stop most evictions. To foreclose during COVID-19, you may not have access to the property until the emergency order is lifted. You could work something out with the resident outside of court.
