Real Estate Joint Venture Agreements

Wise investors ask us to review their joint venture agreement before becoming too involved. Investors like to use our standard agreement with personal adjustments to have an official contract for real estate ventures with other partners. Before you become entangled in a legal obligation, you need to explore the options you have. This includes the risks you are taking. It is wise for you to consult with an attorney for an hourly rate. This protects you from risks of which you are unaware.

Most of the time people have good intentions when they start a real estate venture or sign a contract. Normally, you don’t expect the worst. Victor Maas has been investing since 2003, so he established standard contracts. These work in partnership agreements and other real estate endeavors.

Some common questions and things we can help you with when signing a joint venture agreement are:

  • Is this a good investment property?
  • What are my legal responsibilities?
  • How much could I possibly lose in this transaction?
  • What is the worst case scenario and my legal options in that scenario?
  • What specifics need to be outlined?
Will verbal contracts stand up in court?
  • Can we partner 70/30 on the profits?

What's the worst that could happen?

waiting in a courtroomThe worst thing is to get stuck with a property that becomes a money pit. A noncommittal partner who does not uphold obligations as agreed at the onset is also a negative scenario. Nobody wants these outcomes, but they happen everyday. Simple disagreements such as who should pay the taxes or who pays a bad contractor arise consistently in the real estate industry.

Know your legal avenues. Can you represent yourself? Can you recover lost money? It is common to put a lien against a property? If you are an investor can you put a lien against a property? How do you protect yourself from being taken advantage of in residential real estate? Occasionally, we get a phone call for a consultation after the partner has already put you in a stressful situation. We try to mitigate these experiences ahead of time with a consultation. This can save you from becoming that caller who calls after the fact. Don’t let your investment become complicated. We suggest you work out the kinks prior to investing. We can help you navigate documents, resolve/mitigate disputes, and make informed choices.

FAQ

Yes, you can have an agreement that money will be owed to either party in case of dissolution or other obligations not being met.

You can split profit however you choose; we recommend that it is outlined clearly in your contract.

You can have different profit share, different obligations, different resources used, commitments, dealings with financing and many other things that you might need to consider in creating a good joint venture partnership.

We do deposit money and disperse to parties. Usually this is a security deposit, down payment, or full payment for a property. You would like it safely given to the party, and not run into a scenario, where they say, “They didn’t cash it.” or some other reason or story that sets the transaction back unfairly. These funds are deposited into an escrow account.
