Subject-To Real Estate Transaction Services

A subject-to transaction means that a buyer is purchasing a home subject-to all liens, debts and judgements. It is a creative finance technique where a buyer can take title to the property without obtaining a loan in the traditional manner. In this transaction, the seller of the property maintains the financing. Typically, homeowners who are behind on payments or are already in foreclosure are motivated sellers and good candidates for subject-to purchases. Price: $850 (Setup an appointment here).

Are Subject-To Transactions Complicated?

Buying subject-to means buying a home subject to the existing mortgage and debts. It means the seller is not paying off the existing mortgage, and the buyer is taking over the payments. The unpaid balance of the existing mortgage is then calculated as part of the buyer’s purchase price.

Yes, we require doing a deed of trust for your seller to have recourse if the mortgage is not paid. Without the deed of trust, it is hard for the seller to regain rights to the property if it is not paid. It is required.
